We are still getting inquiries about prenups in which people are seeking one because they believe the property they bring into a marriage will also become their spouse’s upon marriage. This is not the case. Generally speaking, in Texas, your property prior to marriage remains your separate property, not community property. Gifts and inheritance during the marriage are also your separate property.
